On 12th December 2011 a EULEX judge at the District Court of Pristina issued a ruling which dismissed all charges against the former Governor of the Central Bank of Kosovo.
The judge dismissed all five counts against H.R., which included the criminal offences of: abusing official position or authority, trading in influence and fraud.
For some of the counts the reasoning for the dismissal was based on the consideration that, even though the former Governor undertook some inappropriate actions, his conduct was not linked to the exertion of any official power or authority and therefore no abuse of official position could have occurred. In other counts the judge did not find sufficient evidence to support a well grounded suspicion that the defendant committed other criminal offences indicated in the indictment.
The indictment has been confirmed only in relation to count 6 (abusing official position or authority) against I.M., since there was sufficient evidence supporting a well grounded suspicion he had committed the crime.
